Welcome to Essendi Pathways. These Terms & Conditions (“Terms”) govern your use of our website and services. By visiting our site, creating an account, or booking/purchasing services, you agree to these Terms, our Privacy Policy, and our Refund & Cancellation Policy.

 

1) Acceptance of Terms

 

By using our website or services, you acknowledge that you have read, understood, and agree to be bound by these Terms. At checkout, you’ll be asked to actively agree (e.g., by checking a box) to these Terms, including the arbitration and class-action waiver.

 

2) Eligibility

 

You must be 18 years or older and able to form a binding contract to purchase or book services with Essendi Pathways.

 

3) Services

 

Essendi Pathways provides professional life and relationship coaching, offered as:

  • Intro Session (30 minutes) — required for all new clients

  • Single Session — 60 minutes

  • Growth Package — 5 sessions; expires 6 months from the first session

  • Journey Package — 14 sessions; expires 12 months from the first session

  • Monthly Commitment — 3 sessions per standard month (or 4 sessions in 5-week months)

  • Group Sessions — offered on select weeks

We reserve the right to change, suspend, or discontinue offerings at any time.

 

4) Intro Session Requirement

 

All new clients must complete the Intro Session before purchasing a Monthly Commitment, Single Session, or any Package. After the Intro Session, clients may start a Monthly Commitment at any time.

 

5) Payment & Billing

  •  

  • When due: Payment is due at the time of booking.

  • How processed: Payments are handled through Mindbody with Stripe as the payment processor.

  • Authorization: By purchasing, you authorize us to charge your selected payment method.

  • No refunds: All charges are non-refundable. See the Refund & Cancellation Policy for details.

  • Third-party terms: Mindbody/Stripe transactions are also governed by their terms. Our no-refund policy applies to all Essendi Pathways purchases.

 

6) Monthly Commitment (Subscriptions)

  •  

  • Auto-renew: Your Monthly Commitment automatically renews every month until canceled.

  • Renewal reminder: We send a renewal reminder email 3–7 days before your next charge.

  • Cancel anytime: You can cancel online via your Mindbody client account (or by emailing essendipathways@gmail.com with subject “Cancel Monthly”) before the next bill date to stop future charges.

  • No refunds of processed payments.

  • Scheduling window: Sessions occur during active weeks; the 1st–7th of each month is a reset/renewal period with no sessions scheduled.

  • What’s included: 3 sessions per standard month; 4 sessions in 5-week months.

 

7) Refunds, Credits, & Rescheduling (Summary)

  •  

  • No refunds: All purchases are non-refundable.

  • 24-hour credit window: Cancel/reschedule ≥24 hours before a session to receive a credit to use within your package/subscription period.

  • Late cancel/no-show: <24 hours’ notice or no-show = session is forfeited.

  • Group sessions: With ≥24 hours’ notice, you may transfer your spot to another available group session within 6 months of the original session date (subject to availability).

  • Off-premises sales exception: If a purchase occurs off-premises in a context covered by the FTC Cooling-Off Rule, you may have 3 business days to cancel; when applicable, we will provide the required notice and honor that right.

8) Client Responsibilities

 

You agree to:

  • Be on time for sessions and communicate changes ≥24 hours in advance.

  • Engage respectfully and constructively.

  • Refrain from unlawful, abusive, or disruptive behavior in sessions or communications.

Essendi Pathways may suspend or terminate services for violations of these expectations.

 

9) Group Session Conduct

 

To maintain a safe, inclusive environment, you agree to:

  • Treat all participants and the facilitator with respect.

  • Maintain confidentiality of what others share.

  • Refrain from disruptive, abusive, or harmful behavior.

We may remove a participant from a group session (and future sessions) without refund or credit for disruptive or unsafe conduct.

 

10) Coaching Disclaimer

 

Coaching is a forward-focused, collaborative service intended to support personal growth and goals. Essendi Pathways does not provide therapy, counseling, medical treatment, or legal advice. If you are experiencing a crisis or emergency, seek immediate help from a licensed professional or call emergency services.

 

11) Coaching Materials & Intellectual Property

 

All site content, brand assets, and any materials provided in or for coaching (worksheets, exercises, PDFs) are the intellectual property of Essendi Pathways unless otherwise stated. They are licensed for your personal use only and may not be copied, shared, or resold without our written permission.

 

12) Website Use & Prohibited Activities

 

You agree to use the website lawfully. You will not:

  • Hack, disrupt, or attempt to undermine website security or functionality.

  • Use bots/scrapers to harvest data without permission.

  • Post or transmit harmful, defamatory, obscene, or unlawful content.

  • Use the site to send spam, malware, or malicious code.

We may restrict or terminate access for prohibited conduct.

 

13) Pricing & Rate Changes

 

We may change rates and fees at any time; new prices apply to future purchases.

Grandfathered Monthly Commitment Pricing

  • You keep your original monthly rate while continuously subscribed.

  • You may pause up to 3 months for emergencies/life events without losing your grandfathered rate.

  • If the subscription is canceled for more than 3 months, any reactivation uses the current published rate.

 

14) Force Majeure (Unexpected Events)

 

We are not liable for delays, cancellations, or failures to perform caused by events beyond our reasonable control (e.g., illness, power/internet outages, platform failures, natural disasters, governmental actions). We will make reasonable efforts to reschedule affected sessions.

 

15) Limitation of Liability

 

To the fullest extent permitted by law, Essendi Pathways is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising out of your use of the website or services.

 

16) Dispute Resolution & Arbitration (Class-Action Waiver)

 

If a dispute arises, please email essendipathways@gmail.com so we can try to resolve it informally.

If not resolved, any dispute will be resolved by binding arbitration, administered by a recognized arbitration provider (e.g., the American Arbitration Association) under its rules. Arbitration will occur in Lackawanna County, Pennsylvania, or virtually unless we agree otherwise. The arbitrator’s decision is final and binding.

You and Essendi Pathways agree that claims must be brought individually, not as a class, consolidated, or representative action.

 

17) Changes to Terms

 

We may update these Terms at any time. Changes take effect upon posting with an updated “Last Updated” date. Continued use of the website or services after changes are posted constitutes acceptance.

 

18) Governing Law

 

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles.
